Title: Bail Estreatment Hearings

Estreatment occurs when person breaks bail conditions.  If you are thinking of acting as a surety for a friend, family, or loved one, you have a lot to consider. You will be the person in charge of making sure the accused attends their court appearances as needed, and complies with the conditions of their bail release. You will also have to promise to pay a certain amount of money to the court, called a recognizance, that may be collected if the accused breaches the conditions of their bail.If an accused breaches, the matter may move to what is called an estreatment hearing. This is a hearing dedicated to deciding whether the court is able to collect the funds promised by the surety. At the hearing, the surety will be given the opportunity to argue as to why they should not be made to pay the funds. The presiding judge will then decide if the surety must pay all, some, or none of the funds promised.
